The Real Agenda of COS: Completely Change the U.S. Constitution

But the “Convention of States Project” itself proposes limitless ideas for amendments exposing the erroneous idea that COS has any intention of limiting the number of amendments in an Article V Convention.

Phyllis’s extensive writings echoed sentiments set forth by former Supreme Court Chief Justice Warren Burger, who wrote to Phyllis in June 1988 that he believed a constitutional convention was a waste of time, that it could not be controlled regardless of any limits set by Congress, and that it would be a free-for-all for special interests groups.

Hearing in the Nevada Legislature on SJR10

March 27, 2017 was the first hearing in the Nevada Legislature on SJR10 to Rescind all previous applications for Article V Conventions including a BBA. I was asked by the very liberal Democrat Sponsor Senator Segerblom to sit at the table with him and give testimony. Democrat Senator Atkinson on the Committee was so amused by our left-right cooperation that he took our picture to send out on Twitter. The basis of my testimony is in the handout below.

Convention of States Agenda: Every Constitutional Amendment including the Kitchen Sink

The Convention of States deceptively proposes a “limited” convention to “impose fiscal restraints on the federal government and to limit the power and jurisdiction of the federal government.” It sounds reasonable until you realize that the purpose of the entire Constitution was to “limit the power and jurisdiction of the federal government.” It then becomes clear that the COS proposal will open every portion of the Constitution to structural change.

The Article V Convention to Propose Constitutional Amendments: Contemporary Issues for Congress

Article V of the U.S. Constitution provides two methods by which the nation’s founding charter may be amended. The first, Amendment by Congressional Proposal, requires the adoption of an amendment or amendments by a two-thirds vote in both houses of Congress; the second, generally referred to as the “Article V Convention” method, authorizes the states to apply to Congress for a convention for proposing an amendment or amendments. If the legislatures of two-thirds of the states, 34 at present, do, in fact, apply for a convention, Congress is obliged to convene one. Both methods then require the approval of three-fourths of the states, 38 at present, in order to become part of the Constitution.
