Today, the Supreme Court upheld the common-sense laws that keep sports fair for women and girls. 27 states have passed laws that classify athletes based on sex because sex is what matters in sports, and the Supreme Court affirmed this fundamental truth.
“This decision is a victory for girls and women. The Court has reaffirmed what was not, for too long, uncontroversial and unquestioned: girls’ sports are for girls. The Court rejected petitioners’ claims that Title IX and/or the Equal Protection Clause require states to ignore this reality,” said Eagle Forum President Kris Ullman.
“We are pleased the Court has ensured that States can protect women’s and girls’ sports from biological males who want to invade their teams, whether they suffer from gender identity disorders or not. The fact that all nine Justices concurred in part with this decision means it’s game-set-match for those who sought to erode our girls’ access to the fairness promised by Title IX.”
“In addition, the Court found that under the Equal Protection Clause of the 14th Amendment, ‘the States’ sex-based classification — limiting women’ and girls’ sports to biological females — is substantially related’ to the interests of competitive fairness and safety and therefore is constitutional. This decision is a complete and total affirmation of the rights of female athletes to their own teams based on biological sex — one that we have advocated for years.”
Eagle Forum is pleased to have co-signed amicus briefs in both of the cases combined in today’s decision — Little v. Hecox and West Virginia v. B.P.J. — that argued Title IX and the Equal Protection Clause protect the rights of women and girls against unfair and unsafe competition.
“As mothers and fathers who have watched the transgender movement attempt to erase the differences between men and women and deny female athletes the opportunities that are guaranteed in law, we see today’s decision as a touchdown for common sense. Biological differences are real and matter in athletic competition. We are grateful that the Supreme Court upheld the rights of States to protect women and girls. To all the female athletes who now no longer have to worry about losing a spot on the team, or a medal or title to a biological male, we say — Game On!”
