Title IX Sanity Restored

Eagle Forum applauds the U.S. Department of Education for formally rescinding the Biden-era Title IX policies and restoring sex-based protections. The move reinforces Title IX’s original purpose: prohibiting sex discrimination in federally funded education and athletic programs.

“The Biden administration’s attempt to rewrite Title IX undermined the protections Congress established for women and girls,” stated Kris Ullman, President of Eagle Forum. “These policies threatened female athletes’ opportunities, put scholarships and athletic achievements at risk, and compromised women’s privacy in bathrooms, locker rooms, and other intimate spaces.”

Title IX was enacted by Congress in 1972 to prohibit discrimination based on sex in education programs and activities receiving federal financial assistance. In 2024, the Biden Administration issued a new Title IX rule that expanded the regulation’s definition of sex discrimination to include discrimination based on ‘sexual orientation and gender identity’. The rule was subsequently challenged in federal court, and on January 9, 2025, a federal district court vacated the rule nationwide. The Department of Education subsequently returned to enforcing the 2020 Title IX regulations.

Under the current framework, the Department of Education has emphasized protecting female students’ equal opportunities in athletics and maintaining sex-separated facilities such as locker rooms and bathrooms. The Department has also pursued Title IX investigations involving allegations that schools allowed males to compete in women’s sports or access women’s intimate facilities.

“We are thrilled that the Trump Administration is taking action to protect girls across the nation and ensure that they can pursue their athletic dreams without having their opportunities undermined by policies based on so-called ‘gender identity,’” continued Ullman. “Schools must be held accountable for protecting the rights, privacy, safety, and opportunities of female students.”
