On August 7, 2023, Eagle Forum joined an amicus brief in the U.S. Court of Appeals for the Fifth Circuit supporting a challenge against federal government censorship of social media led by the States of Missouri and Louisiana. The challengers received a preliminary injunction against the Biden Administration, which prohibits pressuring social media companies to censor and suppress speech that the government opposes. Our brief explained that the government has no responsibility to prevent wrongdoing, and if it did, it would require the creation of a total surveillance state with totalitarian powers. The government has no authority to stop the distribution of misinformation or to be the judge of information, as the government often spreads its own disinformation. The government also has a history of targeting and abusing independent journalists who speak contrary to the government’s chosen narrative.
