On February 29, 2024, Eagle Forum joined an amicus brief to the Supreme Court in the case, FDA v. Alliance for Hippocratic Medicine. Eagle Forum supports the challenge to the Federal Drug Administration (FDA) brought by a coalition of pro-life medical organizations, who argue that the FDA failed to adequately justify changes to the mifepristone (the abortion pill) regulations that harm women’s health.  For example, when the FDA eliminated the initial in-person doctor visit — the mechanism to diagnose a life-threatening ectopic pregnancy and confirm gestational age — it relied on data that did not include non-fatal adverse events and therefore cannot be an adequate basis for easing the regulation.

The Fifth Circuit Court of Appeals sided with the Alliance for Hippocratic Medicine and the FDA, along with Danco Labratories (the company that manufactures the drug), appealed.
