The letter, signed by 47 national and state policy leaders, urges Governor Noem to support a bill like HB 1217, the “Fairness in Women’s Sports” Act, as originally passed by the state legislature. The bill is designed to protect female athletic opportunities by ensuring that only biological females are eligible to compete in girls’ and women’s school sports.

In 2016 the Obama administration issued guidance protecting transgender students through Title IX. Specifically, this rule allowed transgender students to use restrooms and lockers rooms that did not match their biological sex, but rather the gender they chose. Not only did this force schools to affirm a child’s gender dysphoria, but it also posed as a privacy violation to both boys and girls.

The Obama administration in 2011 unexpectedly revised the 1972 Title IX law to make student-on-student sexual assault accusations on college campuses a civil rights issue as well as a criminal issue. The “Dear Colleague” letter suddenly gave the federal government authority over college student judicial processes for sexual assault cases and, in doing so, reduced due process protections for the accused.
