High Court Takes Hiatus From Judicial Supremacy to Strike Down D.C. Gun Ban, 6-26-08
WASHINGTON, June 26 /PRNewswire-USNewswire/ -- Eagle Forum, a leading pro-family organization founded by Phyllis Schlafly, author of The Supremacists: The Tyranny of Judges and How to Stop It, praises the U.S. Supreme Court's 5-4 ruling today which overturned the D.C gun ban. The case, District of Columbia v. Heller, was argued before the U.S. Supreme Court on March 18, 2008 after the District of Columbia appealed the ruling of the U.S. Court of Appeals for the D.C. Circuit, which affirmed that the Second Amendment to the U.S. Constitution protects an individual right to keep and bear arms. The District's 32-year-old ban on handguns and its requirement that guns kept in the home be unloaded or inoperable at all times, even in cases of self-defense, violates that constitutional right. This case marks the first time since 1939 that a Second Amendment case has reached the Supreme Court.
