Rep. Poe (R-Tx) :The government had to chose in this case. They had to chose between prosecuting a drug smuggler bringing in a million dollars worth of drugs, or prosecuting two border agents that didn't. A chief Barker said, follow protocol and fill out certain forms. And the federal government chose poorly. They chose to prosecute the border protectors instead of prosecute the drug smugglers. And now we have apparently learned that the drug smuggler brought in another load.

According to Sterling E. "Ernie" Norris, Esq., former Los Angeles County Deputy District Attorney (and now with Judicial Watch, Inc. in its West Coast Regional Offices), when immunity was granted, there was a clause at the end of the contract that if the person who was granted immunity committed another crime before testifying in court, that he/she would be stripped of all immunity and prosecuted for the original crime. When Osbaldo Alderete-Davila broke his immunity from prosecution by bringing in another load of marijuana in October, 2005, he should have been prosecuted for both crimes and not have been used against BP Agents Ramos and Compean.
Not only was Alderete-Davila given immunity, he was given a vehicle, courtesy of U.S. taxpayers, a green card to go and come across the U.S./Mexican border, AND how to sue the U.S. government for $5 million dollars for "violation of his civil rights."
In addition, when he was taken to the military hospital in El Paso to have the partial slug taken out of his sorry butt, his surgery "bumped" wounded soldiers waiting for treatment!
The U.S. Government should fire Johnny Sutton and the rest of the prosecution team for their incompetence and withholding of evidence which would free Ramos and Compean.
Ramos and Compean should not be pardoned. A pardon means that they did something wrong. Instead, they should be exhonerated and compensated for all legal bills incurred. And, if they want, should be given back their jobs, with back pay and full compensation.
